Determining a Specific Learning Disability

When a student is suspected to have a specific learning disability, the Lyme School District shall evaluate the student in a manner consistent with federal special education law, state regulations as set forth in NH Ed 1107.01 and .02 and 34 C.F.R. 300.301 to 300.311 (as applicable), and procedures identified in the district manual in the document entitled, “Specific Learning Disability Eligibility Process.”

Eligibility for the disability category of Specific Learning Disability shall be determined through the professional judgment of the Individualized Education Plan (IEP) team using multiple sources of data. In determining eligibility, the IEP team shall consider the student’s pattern of strengths and weaknesses in performance and/or achievement, relative to the student’s age and intellectual development and to state-approved grade-level standards, as well as the manner in which a student responds to instruction and intervention.

In making the determination of eligibility for the disability category of Specific Learning Disability, the IEP team must determine that the student was provided appropriate instruction in the regular education setting, and that the lack of achievement is not primarily the result of a visual, hearing, or motor disability; mental retardation; emotional disturbance; environmental, cultural, or economic disadvantage; or Limited English Proficiency.
